3. General Principles

3.1 What data do we collect from you and from whom do we receive this data?

Primarily, we process personal data that you provide to us or that we collect through the operation of our website. In some cases, we may also receive personal data about you from third parties. These may include the following categories:

  • Personal details (name, address, date of birth, etc.);

  • Contact information (mobile number, email address, etc.);

  • Financial data (e.g., bank account details);

  • Online identifiers (e.g., cookie ID, IP addresses);

  • Location and traffic data;

  • Audio and visual recordings;

  • Special categories of data (e.g., biometric or health information).

3.2 Under what circumstances do we process your data?

We treat your data confidentially and in accordance with the purposes outlined in this privacy policy. We ensure transparent and proportionate data processing.

If we are exceptionally unable to adhere to these principles, the data processing may still be lawful if a justification applies. Justifications include:

  • Your consent;

  • Fulfillment of a contract or pre-contractual measures;

  • Our legitimate interests, provided your interests do not override them.

3.3 How can you revoke your consent?

If you have granted us consent to process your personal data for specific purposes, we will process your data within that scope unless another justification applies.

You may withdraw your consent at any time by sending an email to the address listed in the imprint. Data processing already carried out is not affected by the revocation.

3.4 In what cases can we share your data with third parties?

a. General Rule

We may need to rely on third-party services or affiliated companies and commission them to process your data (so-called data processors). Categories of such recipients include:

  • Accounting, fiduciary, and auditing firms;

  • Consulting firms (legal, tax, etc.);

  • IT service providers (web hosting, support, cloud services, web design, etc.);

  • Payment service providers;

  • Providers of tracking, conversion, and advertising services.

We ensure that these third parties and affiliated companies comply with data protection requirements and treat your personal data confidentially.

We may also be legally obliged to disclose your personal data to authorities.

b. Visiting our social media channels

Our website may include links to our social media channels. These are clearly marked (typically via corresponding icons). When you click on these icons, you are redirected to our social media profiles.

The social media providers will learn that you accessed their platform via our website. They may use this data for their own purposes. Please note that we have no knowledge of the content of the data transmitted or how it is used by the providers.

c. Data transfer abroad

In some cases, personal data may be transferred to companies abroad in the context of data processing. These companies are obligated to data protection in the same way we are. Transfers may take place worldwide.

If the level of data protection does not match that of Switzerland, we carry out a risk assessment in advance and ensure contractual safeguards (e.g., the new EU Standard Contractual Clauses or other legally required measures). If our risk assessment is negative, we implement additional technical protections for your data.

3.5 How long do we store your data?

We store personal data only as long as necessary to fulfill the purposes for which it was collected.

Data collected during your visit to our website is stored for twelve months. An exception applies to analytics and tracking data, which may be stored longer.

We retain contract-related data longer due to legal requirements. Specifically, we are obliged to keep business communication, closed contracts, and accounting records for up to 10 years. Once we no longer need such data to provide services, the data is restricted and used only for accounting and tax purposes.

3.6 How do we protect your data?

We store your data securely and take all reasonable measures to protect it from loss, access, misuse, or alteration.

Our contractors and employees who have access to your data are bound by data protection regulations. In some cases, we may need to forward your requests to affiliated companies. Even in such cases, your data is treated confidentially.

We use SSL (Secure Socket Layer) encryption technology on our website, with the highest level of encryption supported by your browser.

3.7 What are your rights?

a. Right of Access

You may request information about the data we store about you at any time. Please send your request along with proof of identity to info@tsct.ch.

You also have the right to receive your data in a standard digital format if we process your data automatically and if:

  • You have consented to such processing; or

  • You provided the data in relation to a contract.

We may limit or deny data access if it conflicts with legal obligations or the rights of third parties.

We are legally required to respond to your request within 30 days. This deadline may be extended in case of high volume, legal or technical reasons, or if additional information is needed. You will be informed of any extension in text form.

b. Deletion and Correction

You may request the correction or deletion of your data at any time. We may deny the request if we are legally obliged to retain the data or if another legal justification exists.

Please note that exercising your rights may conflict with contractual obligations and affect service delivery (e.g., early contract termination or fees).

c. Legal Recourse

If your personal data is being processed, you have the right to take legal action or lodge a complaint with the appropriate supervisory authority. In Switzerland, the responsible authority is the Federal Data Protection and Information Commissioner (FDPIC):
https://www.edoeb.admin.ch

3.8 Changes to the Privacy Policy

We may amend this privacy policy at any time. Changes will be published at https://tsct.ch; you will not be informed separately.
